01 Overview

Sunny State LLC is a digital marketing and online media studio that helps creators and creator-led brands grow their audience, produce content, and monetize their work. We care about your privacy and aim to handle your information responsibly and transparently.

This Policy applies to information we collect through the Site and in the ordinary course of communicating with prospects, clients, and partners. It does not cover the separate privacy practices of the platforms or third-party services you may use. When we provide services on behalf of a client, we may process information under that client’s direction and agreement. By using the Site or contacting us, you agree to the practices described here.

02 Information We Collect

We collect information in a few different ways, depending on how you interact with us.

Information you provide

  • Contact & inquiries. When you reach out, request a proposal, or sign up to work with us, we collect details such as your name, email address, phone number, company or brand name, and social handles.
  • Project & content information. Information you share about your brand, channels, audience, and goals, along with content, creative materials, and assets you provide for us to work with.
  • Client & engagement details. For clients, information needed to deliver and manage services, including scheduling, billing, and account contacts.
  • Payment information. If you make a payment, it is processed by third-party payment providers. We do not collect or store full payment card numbers on our systems; we may keep limited records such as invoices and confirmation of payment.
  • Communications. The content of emails, messages, forms, and other correspondence you send to us.

Information collected automatically

  • Usage & device data. When you visit the Site, we may automatically collect your IP address, browser and device information, referring pages, the pages you view, and the dates and times of your visits.
  • Cookies & similar technologies. We and our providers use cookies, pixels, and similar technologies as described in Cookies & Tracking.

03 How We Use Information

We use the information we collect to:

  • Respond to your inquiries and prepare proposals, plans, and quotes;
  • Provide and manage our digital marketing, media, content, and monetization services;
  • Plan, create, publish, and measure content and advertising campaigns, including campaigns we run on behalf of clients;
  • Process payments and invoices through our payment providers;
  • Communicate with you about projects, and send service-related or, where permitted, marketing messages — which you can opt out of at any time;
  • Operate, maintain, analyze, and improve the Site and our services;
  • Protect the security and integrity of our Site, prevent fraud, and enforce our terms; and
  • Comply with applicable laws and respond to lawful requests.

04 Cookies & Tracking

Cookies are small files stored on your device that help websites function and help owners understand how they are used. We use a limited set of cookies and similar technologies, including pixels and tags.

  • Essential cookies enable core functionality such as page navigation and security. The Site cannot function properly without them.
  • Analytics cookies help us understand how visitors find and use the Site so we can improve it. This may involve third-party analytics providers.
  • Advertising & marketing cookies and pixels may be used to measure campaigns and show relevant content on third-party platforms. These may be set by advertising partners.

You can control or delete cookies through your browser settings, and many advertising platforms offer their own opt-out and ad-preference tools. Blocking some cookies may affect how the Site works.

Global Privacy Control & Do Not Track

Some browsers offer a Global Privacy Control (GPC) signal. Where required by applicable law, we treat a GPC signal from your browser as a valid request to opt out of the “sale” or “sharing” of personal information for that browser or device. Because there is no common industry standard for “Do Not Track,” the Site does not currently respond to those signals, but we do honor recognized opt-out preference signals as described above.

05 How We Share Information

We do not sell your personal information for money. We do share information with the providers and partners below so we can run our Site and deliver our services. Some analytics and advertising technologies may be considered a “sale” or “sharing” under certain laws — where that applies, you can opt out, including through a Global Privacy Control signal.

  • Service providers. Companies that perform services on our behalf — such as website hosting, email and communications, analytics, scheduling, and payment processing — permitted to use the information only to provide those services.
  • Advertising & analytics partners. Platforms and tools we use to measure performance and deliver marketing and advertising, including on behalf of clients.
  • Contractors & collaborators. Trusted freelancers and partners (for example, editors, designers, or media buyers) who help deliver projects, limited to the information needed to do so.
  • Professional advisors. Accountants, insurers, and legal advisors where reasonably necessary.
  • Legal & safety. When we believe disclosure is required to comply with the law, respond to lawful requests, enforce our agreements, or protect the rights, property, or safety of Sunny State, our clients, or others.
  • Business transfers. In connection with a merger, acquisition, financing, or sale of assets, information may be transferred as part of that transaction.
  • With your consent. In other cases where you direct or permit us to share your information.

06 Third-Party Links & Services

The Site may link to third-party websites or use third-party tools and embedded content, and our work often involves third-party platforms such as social networks and advertising services. We do not control those third parties and are not responsible for their privacy practices. We encourage you to review the privacy policies of any third-party services you interact with.

07 Data Retention

We retain personal information for as long as necessary to fulfill the purposes described in this Policy, including to provide our services, maintain project and account records, comply with our legal and tax obligations, resolve disputes, and enforce our agreements.

When information is no longer needed, we take reasonable steps to delete or de-identify it. The exact retention period depends on the type of information and the reason we hold it.

08 Data Security

We use reasonable administrative, technical, and physical safeguards designed to protect the information we hold against loss, misuse, and unauthorized access, disclosure, or alteration. However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security. You share information with us at your own risk and are responsible for keeping your own account and device credentials secure.

09 Your Privacy Rights

Depending on where you live, you may have certain rights regarding your personal information. Residents of California, under the California Consumer Privacy Act as amended by the California Privacy Rights Act (CCPA/CPRA), may have the rights below. We extend the core of these choices to all of our clients and visitors where practicable.

  • Right to know / access. Request the categories and specific pieces of personal information we have collected about you, and how we use and share it.
  • Right to delete. Request that we delete personal information we collected from you, subject to certain exceptions.
  • Right to correct. Request that we correct inaccurate personal information we maintain about you.
  • Right to opt out of sale or sharing. Opt out of any “sale” or “sharing” of personal information for cross-context behavioral advertising, including via a Global Privacy Control signal.
  • Right to limit use of sensitive information. To the extent we process any sensitive personal information, you may request that we limit its use to what is necessary to provide our services.
  • Right to non-discrimination. We will not discriminate against you for exercising any of your privacy rights.

10 Exercising Your Rights

To exercise any of these rights, contact us at hello@sunnystates.com with enough detail for us to understand and respond to your request.

  • Verification. To protect your privacy, we may need to verify your identity before acting on a request, typically by confirming information we already hold about you.
  • Authorized agents. You may use an authorized agent to submit a request on your behalf; we may ask the agent for proof of authorization and may still verify your identity directly.
  • Response. We will respond within the timeframe required by applicable law. If we cannot fulfill a request, we will explain why.

11 Children’s Privacy

The Site and our services are intended for adults and are not directed to children. We do not knowingly collect personal information from children under 16. If you believe a child has provided us with personal information, please contact us and we will take reasonable steps to delete it.

12 International Visitors

Sunny State is based in the United States. If you access the Site or work with us from outside the United States, be aware that your information will be processed in the United States, where data protection laws may differ from those in your country. By using the Site or contacting us, you understand that your information may be transferred to and processed in the United States.

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, or legal requirements.
